This amendment seeks to clarify that an agent acting under a durable general power of attorney may create a trust if the settlor has expressly authorized the agent to do so.<br /><br />For many years, this understanding guided estate planners throughout the Commonwealth. However, a 2022 Supreme Judicial Court decision created uncertainty around whether agents had this authority, even if explicitly granted in the power of attorney document. This ambiguity has caused concern among estate planners, elder law practitioners, and clients seeking clarity and predictability in planning options.<br /><br />In response, the Massachusetts Chapter of the National Academy of Elder Law Attorneys (MassNAELA) initiated a legislative effort to restore clarity to the statute. BEPC’s Legislative Committee, working closely in collaboration with MassNAELA, the Boston Bar Association (BBA), and the Massachusetts Bar Association (MBA), helped craft and refine updated statutory language. <title>BEPC Signs on to Support Amendment to MA Law Governing Powers of Attorney</title>

<description><![CDATA[<p><span style="color: #2b373e; font-family: Roboto; font-size: 12px; background-color: #ffffff;">The Boston Estate Planning Council Board of Directors recently voted to support an amendment to Massachusetts law governing powers of attorney to clarify that agents acting under a durable general power of attorney have the capacity to create a trust, if expressly authorized by the settlor. This had been the general understanding of practitioners until a 2022 SJC decision cast doubt on the practice, leading the Massachusetts Chapter of the National Association of Elder Law Attorneys to mount a legislative response. <title>Estate Tax Treatment of Out-of-State Real Estate</title>

<description><![CDATA[<span style="color: #403f42; white-space-collapse: preserve; background-color: #ffffff;">In a recently passed bill, the Massachusetts Legislature conclusively defined the Massachusetts taxable estate as excluding real property and tangible personal property located outside the Commonwealth of Massachusetts.&nbsp;This bill was signed by Governor Healey into law on September 16, 2024.&nbsp;Prior to the passage of this amendment, there was some confusion as to whether practitioners needed to prorate the state death tax credit for the portion of the estate attributable to real property located outside of Massachusetts or whether we could rely on Dassori v. <title>Long-Term Care Bill (H.5033) Signed Into Law by Governor Healey</title>

<description><![CDATA[<p style="margin: 0px; padding: 0px; color: #403f42; white-space-collapse: preserve; background-color: #ffffff;">On September 6, 2024, Governor Healey signed into law a provision that restores the viability of pooled trusts for seniors aged 65 or older, essentially repudiating the penalty rule that MassHealth put in place last March 1.&nbsp;The new provision is included as Section 19 of the omnibus Long Term Care bill.&nbsp;It modifies G.L. c. 118E, s. 28, by adding criteria for recognizing fair market value in a self-settled pooled trust for individuals aged 65 or older.&nbsp;Importantly, the calculation of fair market value must include amounts that are reimbursed to the Medicaid program upon the death of the beneficiary.&nbsp;</p><p style="margin: 0px; padding: 0px; color: #403f42; white-space-collapse: preserve; background-color: #ffffff;">&nbsp;</p><p style="margin: 0px; padding: 0px; color: #403f42; white-space-collapse: preserve; background-color: #ffffff;">The <a href="https://malegislature.gov/Bills/193/H5033" rel="noopener noreferrer" target="_blank" data-link-type="web" style="color: #0044aa; font-weight: bold;">new law</a> technically will go into effect on December 6, 2024.&nbsp;The new law merely codifies the recognition of facts about pooled trusts, i.e., the extent to which they show a transfer for value, and not an uncompensated gift.</p>]]></description>
