Seminar Description

Many cross-border planning issues arise involving Canada, when a US citizen resides in Canada, hold Canadian investments, inherits from or marries a Canadian, a U.S. trust includes a Canadian or future Canadian as a beneficiary, or Canadian becomes a dual resident. The presentation will highlight from a Canadian perspective some of the planning considerations for probate, income tax, and estate and gift tax purposes. 

 

Presenters

Rahul Sharma, Partner / Associé , Miller Thomson LLP

Rahul Sharma advises international and Canadian clients on a variety of tax, trust, and estate planning matters. He is particularly experienced with cross-border and international trust and estate matters, as well as matters involving offshore or non-resident trusts with ties to Canada. Rahul also counsels high net-worth individuals, as well as corporations, trusts and estates on Canadian income tax matters, including succession planning for closely held businesses. As part of his practice, Rahul regularly counsels both resident and non-Canadian trustees and trust companies regarding Canadian tax matters. Rahul was recognized by Chambers and Partners as a “rising star” in the area of Private Wealth Law, particularly for his work on cross-border/international matters. Rahul is also recognized by Best Lawyers as a leading lawyer for trust and estate matters.

Fluent in English, French, Spanish, Hindi and Urdu, Rahul regularly speaks on private client and tax topics and has authored and co-authored various chapters, papers and articles on tax, trust and estate related matters. Rahul is the Editor-in-Chief of Thomson Reuters’ Miller Thomson on Estate Planning publication, a cornerstone resource and comprehensive guide to tax and estate planning in Canada. Rahul is also the Editor-in-Chief of Federated Press’ Personal Tax and Estate Planning journal and a co-editor of Thomson Reuters’ Taxes and Wealth Management publication.

Rahul’s broad experience in personal and corporate tax, trust, and estate matters includes:

  • Private client services: tax and estate planning, including for clients with non-resident (including U.S.) beneficiaries and/or cross-border and international asset and property holdings; preparation of tax-planned wills and trust indentures, including in complex domestic and international circumstances; succession planning for business owners and their families; tax planning relating to immigration to and emigration from Canada; tax considerations and planning involving non-resident trusts with links to Canada; Canadian trusts and structures for holding U.S. property investments; and preparation of continuing powers of attorney for property and personal care
  • Tax and corporate tax: corporate reorganizations, including the implementation of “estate freezes” for succession planning; voluntary disclosures and Canadian tax regularization for individuals, trusts, and estates; post-mortem tax planning, including the use of loss carrybacks and pipeline planning; tax advice and assistance for audits and reassessments involving trusts and estates

Approved (2/22/2022): BEPC is a CE Sponsor through the CFP Board. US/Canada Cross-Border Planning 3/22/2022 is approved for 1.00 continue education (CE) hours.

BEPC's educational events may meet the requirements of Rule 15D under the Massachusetts Establishment and Administration of Mandatory Professional Education for the Practice of Public Accountancy.

BEPC is also a CE Sponsor through the CFP Board. BEPC applies for CE credit approval through the CFP Board for our educational events. The certificate of completion provided will state if the seminar was approved by the CFP Board for CE credit.

BEPC issues certificates of completion for educational events. The certificates list the number of CPE credit hours or CE credits awarded for the event. Attendees are encouraged to use the certificate to provide proof to the certifying body for their certifications, designations, licensure, etc. For example, an attendee with AEP designation could use the certificate for the continuing education requirements set by NAEPC.
