Proceed with Caution: Planning with Non-Grantor Trusts

Description

As interest in nongrantor trusts surges, it’s important to separate the hype from the reality. This session will explore the growing popularity of nongrantor trusts in tax planning, why they're being so widely promoted, and what planners need to watch out for. Attendees will gain a clear understanding of the potential tax benefits these trusts can offer—as well as the limitations and unintended consequences that can arise. Whether you're considering using a nongrantor trust or advising others, this lecture will provide practical insights to help determine when these vehicles make sense—and when they don’t.

Jordana Schreiber counsels high net worth individuals and families in theareas of estate, gift and succession planning, will and trust preparation,charitable giving, and estate and trust administration. She has extensiveexperience preparing estate planning documents including wills, revocabletrusts, irrevocable life insurance trusts, grantor retained annuity trusts, andqualified personal residence trusts. Her practice includes developing estateand gift tax minimization strategies, generation-skipping transfer taxplanning, insurance planning and philanthropic planning. She assists clientswith probate and trust administration and other general matters relating todaily administration of estate plans.

Jordana also facilitates the creation and operation of non-profitorganizations, including handling related tax matters.

Jordana was a Lecturer-in-Law, from 2011 to 2013, on trust and estatedrafting at Boston University School of Law. From 2011 to 2012, she was anadjunct professor in legal research and writing at New England School ofLaw.

Large IRA's: Jeez, its not all mine?

Description

Approximately 10,000 people per day are turning 65 and starting to retire. Many have worked for 30+ years and been saving into tax-deferred accounts. The stock market has been very kind. Very little attention was paid to the decumulation challenges and many are shocked and dismayed when they learn about income and estate taxes as well as other challenges and obstacles. Some strategies to share with clients.

Martin brings 30 years’ experience and education to business owners, wealth creators, C-suite executives and pre-retirees helping them understand the risks present on their balance sheets and then guide them to their desired outcomes using uncommon and non-traditional strategies. The results he is aiming for are less risk, more certainty, tax optimization, asset spend down with full legacy and replacement for future generations. 

He was one of the youngest members of the Johannesburg Stock Exchange at 23 and one of the founding members of the equity options, financial futures and commodity exchanges in South Africa.

He spent 10 years as a partner at a boutique investment bank where he oversaw the nationwide trading desk. The firm also helped small to medium-size enterprises access capital with mezzanine finance, IPO and asset securitization.

He has a Bachelor of Commerce from the University of Cape Town as well as an MS in Investment Management from Boston University. He is an active angel investor and sponsor of Boston Harbor Angels. He is a member of the MDRT, Million Dollar Round Table. He holds FINRA 7, 63 & 65 registrations and have earned the following designations: AEP® (Accredited Estate Planner), CLU® (Chartered Life Underwriter), ChFC® (Chartered Financial Consultant), WMCP® (Wealth Management Certified Professional), RICP® (Retirement Income Certified Professional), CAS® (Certified Annuity Specialist), CLTC® (Certification for Long Term Care Certification). Session 3

Doesn't Anyone Stay in One Place Anymore?

Description

Your client’s child studied in Germany, met a boy, and fell in love. Now the child is married to a German, has a dual citizen child, and lives in another country.  Your client took a trip to France, fell in love with the country, and bought a villa.  Your foreign client took a trip to Massachusetts and now wants to buy a vacation home on the Cape and open a bank account.  You are an estate planning attorney who has been contacted by someone whose deceased brother once worked in the U.S. and has an investment account with some stock from his old company.  All these situations have potential estate, inheritance, and income tax consequences.  As families have become more global, professionals in estate planning and financial planning need to have some basic understanding of issues that might arise when dealing with these international situations. In this session, we will explore some of the tax issues that might arise in these cross-border situations.

With over 25 years of experience working for a diverse group of clients, Jen has seen many different types of families, many of whom have complex family situations. Jen loves helping clients carry out their philanthropic wishes, both through lifetime gifting and in their estate plan.

Jennifer advises clients on sophisticated planning techniques such as GRATs, SLATs, ILITs, QPRTs, charitable trusts, asset protection planning, and other types of gift trusts. She frequently works with clients who have significant wealth in retirement plans to construct a plan that is tax efficient, while still meeting their family legacy goals, especially important in the post-SECURE Act world.

Jen’s practice has evolved over the years to include advising clients with cross-border issues. She counsels such clients on estate planning, gifting, and taxation from the U.S. perspective, including pre-immigration planning, often collaborating with attorneys and other advisors from foreign countries to develop a comprehensive, tax-efficient plan. Jennifer also works with clients on estate settlements involving foreign assets, including preparing estate tax returns, requesting transfer certificates, and ensuring foreign tax reporting compliance.

Certificates of Completion

BEPC's educational events may meet the requirements of Rule 15D under the Massachusetts Establishment and Administration of Mandatory Professional Education for the Practice of Public Accountancy.
BEPC is also a CE Sponsor through the CFP Board. BEPC applies for CE credit approval through the CFP Board for our educational events.
BEPC also applies for CE credit approval through the American Bankers Association to support CTFA designees.
BEPC issues certificates of completion for educational events. The certificates list the number of CPE credit hours or CE credits awarded for the event. The certificate will also state if the seminar was approved by the CFP Board or ABA for CE credit.
