Seminar Description

This session examines a range of recent developments with an emphasis on their practical impact on planning for clients.  The discussion includes legislative developments (Build Back Better Act, Corporate Transparency Act), regulatory and administrative guidance (anticipated SECURE Act proposed regulations, new life expectancy tables for retirement plan distributions, new life expectancy tables), general planning issues (including trust modifications), case law developments (including CCA 202152018 about GRATs, Smaldino, Buck, Connelly, Hewitt, and others), and a variety of other developments. 

Learning Objectives:
Knowledge of anticipated legislative tax developments; understanding minimum distribution calculations for IRAs and retirement plans using new life expectancy tables; sensitivity to unanticipated income and transfer tax effects of trust modifications; dangers of indirectly making gifts “through” someone else; valuation dangers of buy sell agreement pricing provisions that are not binding on the IRS for estate tax purposes; valuation effects of corporate-owned life insurance to fund buy-sell agreements; and awareness of unprecedented IRS position regarding possible huge gift risks with GRATs if inappropriate appraisals are used to value contributions.   

 

Presenters

Steve R. Akers, Managing Director
and Senior Fiduciary Counsel

Mr. Akers is Managing Director and Senior Fiduciary Counsel at Bessemer Trust. In this role, he serves as Chair of the firm’s Estate Planning Committee and works closely with clients in the Southwest Region regarding their estate and trust planning issues. 

Steve serves as Immediate Past President of the American College of Trust and Estate Counsel (ACTEC) and is a member of the Advisory Committee to the University of Miami Philip E. Heckerling Institute on Estate Planning, where he is a frequent speaker. He has previously served as Chair of the American Bar Association Section of Real Property, Trust & Estate Law and as Chair of the State Bar of Texas Real Estate, Probate & Trust Law Section.

Steve earned a J.D. from the University of Texas School of Law and a B.S. in chemical engineering from Oklahoma State University.

BEPC's educational events may meet the requirements of Rule 15D under the Massachusetts Establishment and Administration of Mandatory Professional Education for the Practice of Public Accountancy.

BEPC is also a CE Sponsor through the CFP Board. BEPC applies for CE credit approval through the CFP Board for our educational events. The certificate of completion provided will state if the seminar was approved by the CFP Board for CE credit.

BEPC issues certificates of completion for educational events. The certificates list the number of CPE credit hours or CE credits awarded for the event. Attendees are encouraged to use the certificate to provide proof to the certifying body for their certifications, designations, licensure, etc. For example, an attendee with AEP designation could use the certificate for the continuing education requirements set by NAEPC.
